What Does an Assistant Public Prosecutor Do?
An APP is a government lawyer who conducts criminal cases on behalf of the State, usually before Magistrate courts. The APP does not represent the police or the victim personally. The role is to present the case fairly for the State.
Legal Framework Behind the Post
- Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS): the criminal procedure law that replaced the CrPC from 1 July 2024. Section 18 deals with Public Prosecutors, Section 19 with Assistant Public Prosecutors in Magistrate courts, and Section 20 with the Directorate of Prosecution.
- Advocates Act, 1961: governs enrolment with a State Bar Council. Your three years of practice are counted from enrolment.
- Constitution of India: Article 16 guarantees equal opportunity in public jobs, Article 16(4) permits reservation, Article 16(6) covers the Economically Weaker Section (EWS) quota, and Article 320 gives UPSC the role of recruiting for government posts.
- Rights of Persons with Disabilities Act, 2016: Section 34 provides reservation for persons with benchmark disabilities (PwBD).
- Bharatiya Nyaya Sanhita, 2023 (BNS): Sections 318 (cheating) and 336 (forgery) can apply to false claims or forged documents.

Eligibility Criteria
Education: A law degree from a recognised university, either a 3-year LLB after graduation or a 5-year integrated law course. LLM is not required.
Experience: At least 3 years at the Bar as a practising advocate after Bar Council enrolment. Experience as a Government Advocate is desirable, not mandatory, though it may help in shortlisting if applications are very high.

- Complete One Time Registration (OTR) if you do not have an account, then log in with your registration number.
- Fill the Common Application Form with personal details, address and a live photograph.
- Sign three times on plain white paper in black ink and upload the scanned signature in the prescribed format.
- Open the post-specific module for Assistant Public Prosecutor and enter your education details.
- Upload supporting documents in the right format and file size.

Selection Process
UPSC will decide whether a written recruitment test is held, depending on the number of applications. Shortlisted candidates are then called for an interview or personality test. Dates, syllabus, admit cards and centres will be announced on the UPSC website and sent to your registered email, so keep that email active.
