What is a “Dowry Death”?

A dowry death refers to the death of a married woman caused by harassment or cruelty related to dowry demands.

In simple terms:
If a woman dies under suspicious circumstances within a few years of marriage, and she was being harassed for dowry—the law treats it very seriously.

Earlier Law: Section 304B of the Indian Penal Code, 1860

Section 304B specifically dealt with dowry deaths.

Key Ingredients:

For a case to qualify as dowry death:

  1. The woman’s death must be:
    • By burns, bodily injury, or
    • Occur under unnatural circumstances
  2. It must happen within 7 years of marriage
  3. She must have been subjected to:
    • Cruelty or harassment
    • In connection with dowry demands
  4. Such harassment occurred “soon before her death”

Punishment under Section 304B IPC

Minimum: 7 years imprisonment

Maximum: Life imprisonment

New Law: Section 80 of Bharatiya Nyaya Sanhita, 2023

With the introduction of BNS, Section 304B IPC has been replaced by Section 80 BNS.

What has changed?

Mostly, the law remains the same in substance.

Section 80 BNS retains:

  • The same definition of dowry death
  • The same conditions (7 years, cruelty, dowry link)
  • The same punishment range

Important Legal Presumption

Under the Indian Evidence Act, 1872:
